1. Who We Are

Infinia Migration provides Australian migration advice and assistance through Registered Migration Agent Maria Sol Subizar (MARN 2619466).

This Privacy Policy explains how Infinia Migration collects, holds, uses and discloses personal information in connection with enquiries, consultations, client matters and use of our website.

2. Information we may collect

The information we collect depends on the nature of your enquiry or migration matter and may include:

  • name, contact details, date of birth, nationality and preferred language

  • passport, identity and civil-status documents

  • visa status, migration history, travel history and Department correspondence

  • education, qualifications, employment and skills information

  • sponsorship and employer information

  • financial and family information relevant to your matter

  • consultation notes, communications, service agreements, invoices and payment records

  • sensitive information, including health information or criminal history, where relevant to your matter and collected with your consent or otherwise permitted or required by law.

Please do not send identity documents or sensitive information through a general website enquiry unless requested. Where appropriate, we will provide a secure method for supplying documents.

If you provide personal information about another person, including a partner, family member, employee or sponsor, you should have appropriate authority to provide that information.

3. How and why information is collected

Information may be provided directly through email, telephone, consultations and documents. Where authorised or otherwise permitted by law, it may also come from a representative, sponsor, assessing authority or government agency involved in your matter.

We use relevant information to respond to enquiries, understand your circumstances, provide advice, prepare and manage agreed applications, communicate with you, administer our services and meet applicable professional and legal obligations.

You may make a general enquiry without identifying yourself where practicable. If information needed for advice or an application is not provided, we may be unable to assist or may need to limit the assistance we provide.

4. Confidentiality and Disclosure

Infinia Migration is subject to professional confidentiality obligations under the Migration Agents Code of Conduct.

Except where disclosure is required by Commonwealth, State or Territory law, a migration agent must not disclose personal information relating to a client or former client, or their affairs, to a third party without the client’s written consent.

Where authorised, relevant information may be disclosed to parties involved in your matter, including:

  • the Department of Home Affairs

  • skills assessing authorities

  • the Administrative Review Tribunal or other review bodies

  • employers and sponsors

  • medical and police-check providers

  • translators and interpreters

  • professional advisers

  • government agencies

  • other persons or organisations reasonably involved in providing the agreed services.

Infinia Migration may also disclose information where required or authorised by law.

5. Storage, Security and Retention

Infinia Migration takes reasonable steps to protect personal information and client documents from misuse, loss and unauthorised access, modification or disclosure.

Electronic information may be stored through the business systems and service providers used by Infinia Migration. Access is limited to persons who require the information for legitimate professional or business purposes. Client documents are kept securely in accordance with the Migration Agents Code of Conduct.

Infinia Migration creates and maintains client files in accordance with professional obligations. A client file may include applications, service agreements, correspondence, records of oral advice and instructions, communications with third parties, invoices and receipts, personal documents and other material relevant to the matter.

Where substantive oral advice or instructions are provided in relation to immigration assistance, Infinia Migration may create contemporaneous written records of those communications as part of the client file.

Registered migration agents must take reasonable steps to retain client files for 7 years after the last action on the file. Information that is not required to be retained under professional or legal obligations may be securely destroyed or de-identified when no longer required.

Clients may request in writing the return of documents to which they are entitled. Relevant client documents must generally be returned within 14 days of receiving a written request, in accordance with the Migration Agents Code of Conduct.

No electronic system can be guaranteed to be completely secure. If you believe information you have provided to us may have been compromised, please contact us promptly.

6. Payments and Online Consultations

Payments may be made by Stripe or bank transfer. Where Stripe is used, payment and transaction information is processed through Stripe’s systems, and Infinia Migration does not receive or retain complete payment card details. Where payment is made by bank transfer, relevant transaction information may be processed by the financial institutions involved.

Online consultations may be conducted through Zoom. Information shared during a consultation may form part of your consultation or client record. Unless specifically advised otherwise, consultations are not recorded.

We recommend joining online consultations from a private and secure location where possible.

7. This Website

Our contact form uses Web3Forms to deliver enquiries. Information you enter is processed by Web3Forms and sent to our nominated email address so we can respond. Please do not include passport numbers, identity documents or sensitive personal information in this form.

When enabled, we use Google Analytics to understand website visits and Microsoft Clarity for heatmaps and recordings of how pages are used. Google Tag Manager manages these integrations. These providers may process technical information such as IP addresses, device and browser information, pages visited, referral information and interactions, and may use cookies. We exclude contact-form contents from analytics events and mask form inputs in Clarity.

We use an approximate country indication supplied by our hosting provider, Vercel, to determine whether to ask before enabling optional tracking. We ask visitors outside Australia, or where the country is unknown. You can accept or reject tracking and change your choice using Privacy preferences in the footer when tracking is available. Your choice is stored in your browser for up to six months. Contact enquiries and booking links work without accepting analytics.

Our hosting, form and analytics providers may process information outside Australia. Their privacy policies explain their processing, retention and international arrangements: Vercel, Web3Forms, Google and Microsoft.

Consultation bookings, questionnaires and client portal functions are managed separately through LodgeHQ. Information provided through LodgeHQ may form part of your consultation or client record. External websites and services have their own privacy practices.

8. Access, Correction and Regulatory Access

You may contact Infinia Migration to request access to personal information held about you or to request correction of information that is inaccurate, incomplete or out of date.

We may need to verify your identity before responding to your request. Where access or correction cannot be provided, we will explain the reason where appropriate and subject to applicable legal restrictions.

Infinia Migration may also be required to provide access to client files or information to the Office of the Migration Agents Registration Authority (OMARA) or another government or regulatory authority where lawfully required.

Under the Migration Agents Code of Conduct, a registered migration agent may be required to provide OMARA with access to a client file where a written request is made for the purpose of carrying out its statutory functions.

Please explain your concern and the outcome you are seeking. We will review the circumstances and respond within a reasonable timeframe.

Where applicable, you may also seek information from the Office of the Australian Information Commissioner (OAIC) about available privacy complaint options.
